A divided Colorado Supreme Court on Tuesday dismissed a transgender woman’s discrimination lawsuit against the Christian baker who refused to create a pink cake with blue icing to celebrate her gender transition birthday.

Colorado's top court on Tuesday ducked the question of whether a Christian baker had the right to refuse to create a cake for a customer celebrating a gender transition by dismissing the discrimination case on procedural grounds.

Scardina, who is also a Christian, pursued a discrimination claim against Phillips after he refused to bake the cake in 2017. She filed a claim under Colorado’s Anti-Discrimination Act, or CADA, which prohibits businesses from refusing services based on protected characteristics like race, religion or sexual orientation.
